How Bright Pathway Interacts with Students!

Welcome to Bright Pathway. By accessing and using Bright Pathway, including brightpathway.co.uk and its associated sites, services, and tools, you are agreeing to the following terms. These terms of service apply to all our products and aim to outline the responsibilities of both users and Bright Pathway. 

1.Definitions

  • The terms used in this Agreement are defined as follows:
    1. Course Provider: The entity responsible for creating, operating, and publishing the Course publicly. References such as Course Provider, us, we, our, ours, and other first-person pronouns pertain to the Course Provider, along with, if applicable, all employees and affiliates.
    2. You (User/Participant): Refers to the user and participant in the course, addressed throughout this Agreement with second-person pronouns such as you, your, yours, or as user or participant.
    3. Parties: Collectively, the Course Provider and You (user/participant) are collectively referred to as Parties.
  • Other key definitions include:
    1. Course Fee: The fee payable for any Course or product, excluding delivery charges related to certificates (if applicable), and any import duties, taxes, and customs clearances.
    2. Course Materials: Materials provided by us during the delivery of any Online Course, including Online Study Materials.
    3. Online Course: Courses listed on the website, accessible at any time with the provided login credentials.
    4. Online Study Materials: Electronic materials available for download or accessed on the Moodle platform, encompassing formats such as PDFs, MP3s, JPEGs, MPEG4s, MOVs, and others.
    5. Website: Refers to www.brightpathway.co.uk or any other domain operated by Bright Pathway.

2.Website and Course Materials Usage License

Upon accessing the Course through the Website, a non-exclusive, limited, and revocable license is granted to utilise provided Materials for participation in the Course. These Materials, including documentation and data, are intended solely for Course-related use and Website engagement. The license terminates upon Course completion, cessation of Website or Course use, or upon Agreement termination. Any use beyond these parameters is strictly prohibited. Your compliance with these terms is crucial for adherence to this Agreement.

3.Your Obligations/Responsibilities

    1. As a participant in the Course, registration is a requisite, during which you will select a user identifier, such as your email address. You may also provide personal information, including, but not limited to, your name, date of birth, address confirmation, and proof of identification for which ensuring accuracy is incumbent upon you. It is imperative to provide these data within the stipulated timeframe communicated in relevant communications.
    2. This identifying information is pivotal for your active participation in the Course, and utmost care should be taken to avoid sharing it with any third party. In the event of compromised identifying information, immediate written notification, preferably via email, is mandatory. Your responsibility extends to maintaining the safety and security of this information and promptly informing us of any changes.
    3. The confidentiality and accuracy standards also applicable to identifying information extend to billing details, including credit card information and billing address. Providing false or inaccurate information or utilising the Course or Website for fraudulent or unlawful activities constitutes grounds for the immediate termination of this Agreement.
    4. Additionally, your obligations as a participant encompass timely payment of agreed fees, adhering to the terms agreed upon at the time of booking.
    5. Completing assignments within agreed timescales is imperative, and in instances where this is challenging, open discussions with your tutor are encouraged.
    6. Maintaining regular contact and a cooperative attitude with your course tutor, who plays a pivotal role in facilitating your learning, is expected.
    7. Unless explicitly stated otherwise, candidates are expected to possess English, Literacy, Numeracy, and ICT skills at Level 3 or above.
    8. The submission of original work is mandatory, and any external materials, graphics, quotations, or information must be clearly referenced using the Harvard referencing system, with guidance provided for clarity.

4.Learner Declaration

I hereby declare that all information supplied in the Learner Registration Form, both during the initial registration process and subsequently, is accurate, and all pertinent details have been transparently disclosed. Whether signing this document electronically or in person, I affirm my complete agreement with the Terms and Conditions set forth by Bright Pathway.

5.Enrolment Conditions

    1. To fulfil English language proficiency and entry criteria, all necessary documents must be submitted during enrolment.
    2. Upon enrolment in an accredited course, access to study resources and the initial unit assignment will be granted. Subsequent units/assignments become accessible upon completion of the previous ones. This cycle continues until all units are successfully passed.
    3. In the event of a break exceeding 60 days without prior agreement and payment, Bright Pathway reserves the right to terminate admission and pursue outstanding debts due to fixed overhead costs.
    4. Taking learning materials outside our centres for personal or professional use is against our terms and may result in theft reporting. Eligibility criteria must be met before course booking, as ineligible candidates will be refused attendance without refund.
    5. Prices are subject to change until full payment or a deposit is made. Upon course booking, a welcome email is sent, and if not received within 48 hours (after checking spam/junk mail), contact us for reissuance.
    6. Bright Pathway is not responsible for misplaced certificates in the post, and replacement costs £50.
    7. Unacceptable behaviour at Bright Pathway leads to exclusion without refund. Failure to comply with course requirements or terms results in removal from the course, with forfeited fees.

6.Course Terms

    1. The Course, with no structured start date, can commence at any time. It expires as specified on the course page or after 12 months in the absence of duration information.
    2. Sharing the Course or Materials is prohibited, and suspected sharing or login information violation may lead to immediate termination of access.
    3. No promises or guarantees are offered for the Course or Materials. You acknowledge and agree that:
      a. You are solely responsible for choices related to the Course and any impact on your business or life;
      b. You are responsible for your mental and physical health, business decisions, and actions or inaction;
      c. We are not liable for any results or consequences arising from your participation in the Course;
      d. We do not provide therapy or medical services; you are responsible for procuring these services at your discretion if needed.

7.Fee Payment

    1. To commence your chosen course, all course fees, as per the selected plan, must be settled before the start date. Payment methods include debit/credit cards and bank transfers. Instalment plans are available for all courses but must be agreed upon at the course commencement.
    2. Upon registration and initial payment, a legally binding contract is established, necessitating full payment of the course fee and registration fee. Non-payment or non-compliance with instalment plans may result in a breach of contract, empowering Bright Pathway to pursue legal means for debt recovery. In default situations, additional fees may be imposed through a debt recovery agency, and access to services may be blocked until overdue amounts are settled.
    3. Prices shown are all-inclusive of VAT—no extra charges!

8.Payment Methods

Payment of the Course Fee can be made

    1. With a one-off lump-sum payment, payable with your purchase offer; or
    2. In instalments, with payments due at specified times over a set period, as detailed on the Website, Brochure, or as notified by Bright Pathway. The first instalment (Initial Payment) is due with your purchase offer, and subsequent instalments follow agreed dates.

If opting for instalments, you agree:

    • To sign up for a Gocardless account through the provided link or create the plan independently.
    • To ensure instalment payments are made on due dates.
    • Bright Pathway is authorised to collect instalment payments from the Gocardless account (or another agreed method).
    • The initial payment must be realised in the Course Provider’s account for course access.
    • To inform Bright Pathway of any change in the linked bank account or insufficient funds before the next instalment.
    • Late payments incur a £10/reminder email charge for administrative costs.
    1. Failure to make an instalment payment constitutes a breach of the Contract, potentially resulting in loss of the right to pay by instalments. Bright Pathway may suspend or cancel course access until outstanding instalment amounts are paid in full.
    2. The total amount paid may differ based on lump-sum or instalment payment methods. Payment methods include credit card, debit card, and bank transfer.
    3. In the rare event that your purchase offer is accepted with an incorrect Course Fee on the Website or in any Brochure, Bright Pathway will promptly notify you.
    4. If the correct Course Fee is higher than initially displayed, Bright Pathway will inform you of the accurate amount, allowing you to decide whether to proceed with the order at the increased Course Fee.
    5. If you choose to cancel your order in this situation, Bright Pathway will provide a full refund for any amount already paid.
    6. Conversely, if the correct Course Fee is lower, Bright Pathway will reimburse the difference between the amount paid and the correct Course Fee.

9.Discount Codes

Bright Pathway issues promotional and discount codes for various reasons on different occasions. These codes are valid for a limited time, with specified expiry dates. Only one discount code can be applied during checkout, and using multiple codes simultaneously is not possible.

10.Cancellation of Course and Fee Refunds

    1. According to the Consumer Protection (Distance Selling) Regulations 2000, cancellation is allowed within a 14-day period from the purchase contract conclusion.
    2. Refunds are eligible within 14 calendar days from the purchase contract conclusion if the course or Moodle (Virtual Learning Platform) has not been accessed.
    3. Accessing/using e-learning or other online services disqualifies candidates from claiming a refund under the Distance Selling Regulations (DSR).
    4. Special considerations may be applied on a case-by-case basis at our sole discretion.
    5. Only non-accredited courses are non-refundable.
    6. If cancellation occurs within the stipulated period, a 20% admin and registration fee applies, with the remaining deposit/amount refunded within 30 days if eligible.
    7. Once a course is redeemed, no refund can be granted. All refund requests must be submitted through the refund form.

Please note: Refunds may take up to 30 working days to process. For corporate candidates, switching registrations or replacing candidates is considered on a case-by-case basis. Contact account manager or email info@brightpathway.co.uk for further assistance, taking into account the prior candidate’s registration duration and access to online services.

11.Refund Policy for Non-Website Purchases

In accordance with this policy, customers who have made a purchase through a platform other than the website may cancel their course within a 14-calendar-day period from the date on which the purchase contract is concluded. This designated timeframe is referred to as the “Cancellation Period.” It’s important to note that initiating access to course materials during this timeframe explicitly indicates the commencement of the learning. As a consequence, you acknowledge forfeiting the right to cancel the course purchase and receive a refund.

12.Reordering Printed Certificates

There are circumstances under which a reordering of a printed certificate may be necessary:

    1. Lost in Transit/After Delivery: In the event that your certificate is dispatched but is lost during delivery or misplaced after delivery, a Reorder Certificate Fee is applicable for obtaining another copy of the printed certificate.
    2. Delivery Failure Due to Erroneous Address: If the provided delivery address is incorrect, resulting in delivery failure, a reordering fee will be charged to facilitate the delivery of the certificate. If the error is attributable to us, no additional fee will be incurred to deliver the certificate to the correct address.
    3. In Transit Damages: Damages incurred to the printed certificate during transit are not within our responsibility. We ensure that the certificate is dispatched in its original condition and with the utmost packaging care to prevent any physical damage during transit.
    4. Changes to the Certificate: In cases of errors identified in the certificate within three months of issuance, we will reissue the certificate at no additional charge if the error is on our part. However, if the error is due to incorrect information provided by the learner, a reissue fee is applicable. The reordering process takes 2 to 4 weeks after the submission and verification of the request.

Please note: The reordering fee for a certificate is £50. If you opt to receive a hard copy outside the United Kingdom, supplementary courier charges will be incurred.

13.Courier/Postage Charges

All qualification fees include courier/postage charges for certificate dispatch services within the United Kingdom. However, for recipients outside the UK, a delivery fee corresponding to the location will be charged.

14.Assignment Submission Procedures

It is imperative to adhere to the assignment submission guidelines for each unit, as successful submission is a prerequisite for progressing to the subsequent unit/assignment. Fortunately, our courses offer the flexibility of self-paced learning, devoid of imposed deadlines.

All assignments must be submitted through Moodle, our Virtual Learning Platform (VLE). Thorough training on utilizing Moodle and submitting assignments will be provided through a detailed guide.

15.Assignment Review Process

Please be aware that assignments assessed by a tutor will undergo internal verification before results are released to learners. This involves potential feedback and guidance to enhance specific elements of your assignment, ensuring alignment with the standards of the awarding organisation. In the event improvements are necessary, you will receive clear guidance and sufficient time for refinement. Importantly, there is no restriction on the number of times you can resubmit your work, provided you demonstrate reasonable progress and a commitment to improving your submissions.

16.Plagiarism Policy

At Bright Pathway, we maintain a rigorous stance against plagiarism, conducting regular and random assessments of students’ work to mitigate the risk of academic misconduct. Plagiarism is defined as the act of presenting someone else’s work as one’s own, whether or not consent is obtained, through the incorporation of unacknowledged content. In cases where plagiarism is suspected, the student will be notified and requested to resubmit the work. Multiple instances of plagiarism will result in the student’s disqualification from completing their qualification with Bright Pathway, with no refunds issued.

It is strongly advised to carefully follow the provided instructions during the induction process. Upon enrollment, you will receive relevant policies to ensure proper understanding of how to submit your work.

17.Use of AI Tools

Bright Pathway maintains a stringent policy on academic integrity, extending to the utilisation of Artificial Intelligence (AI) tools such as ChatGPT in students’ academic work. While limited use of AI tools for tasks like idea generation or planning may be deemed appropriate in certain assessment contexts, it is crucial to emphasise that an excessive reliance on AI tools, particularly for composing entire assessments or substantial portions, is strictly prohibited as this can lead to ethical concerns and is regarded as a form of plagiarism.

Students are strongly advised against relying excessively on AI tools and should ensure that any usage aligns with established academic standards. Proper referencing and acknowledgment of AI-generated content are essential to prevent violations of our Malpractice and Maladministration Policy. Bright Pathway encourages students to seek guidance on the judicious and ethical use of AI tools in their academic pursuits.

18.Use of Samples on Moodle - VLE

The samples provided on Moodle are intended solely for your guidance and assistance, offering a reference point to understand how to approach specific tasks or assignments. These samples are designed to help you comprehend the expectations and structure associated with various assignments.

It is crucial to note that while these samples serve as helpful tools for learning, directly copying content from them is strictly prohibited. Copying verbatim from the samples without proper attribution is considered a violation of our plagiarism policy. Students are expected to use the samples on Moodle as a reference for understanding, learning, and refining their own approach to assignments rather than reproducing the content as their own.

19.Course Transfers

Bright Pathway does not facilitate the transfer of courses from one category to another. In rare instances where a transfer is deemed necessary, we do not commit to refunds for the original course. However, we are open to reviewing exceptional cases on an individual basis. Alternatively, you will be required to complete the payment for both the tuition fee and the awarding body fee associated with the new course.

20.Course Accreditation

All our courses hold accreditation from awarding organisations sanctioned by The Office of Qualifications and Examinations Regulation (Ofqual), the primary regulatory body in the UK. In the event of any alteration in the awarding body partnership, Bright Pathway is committed to ensuring that the new governing body maintains or surpasses the standards set by its predecessor.

21.Student Information

Bright Pathway prioritises the protection of student data. We retain only essential information, such as email addresses and phone numbers. Our commitment to data security is reflected in our registration with the Information Commissioner’s Office.

22.Maintaining Updated Records

It is imperative to inform Bright Pathway promptly of any changes to your details post-registration for a course. This encompasses alterations to your name, contact number, email address, and correspondence address. This proactive approach ensures the accuracy and currency of your records with us.

23.VLE – Terms of Use

In utilising our Virtual Learning Environment (VLE) – Moodle, you are required to adhere to prevailing legislation, encompassing the Computer Misuse Act 1990, General Data Protection Regulation (GDPR) of May 2018, Protection from Harassment Act 1997, Copyright, Designs & Patents Act 1988, Telecommunications Act 1984, Variations/Correction of Errors and Inaccuracies, Warranty Disclaimer, Limitation of Liability, Governing Laws and Jurisdiction. Essentially, this mandates the respectful acknowledgment of your rights, the centre’s rights, and those of other VLE users.

24.Learner Behaviour

Bright Pathway strictly prohibits unethical and inappropriate conduct towards staff members or fellow learners. This prohibition extends to threats via telephone, written communication, emails, or the use of inappropriate language. In instances of such behavior, Bright Pathway reserves the right to expel the learner from the course, with no entitlement to a refund, and the remaining instalment will remain obligatory.

26.Spam Policy

Engaging in illegal spam activities, which includes the collection of email addresses and personal information from others or the sending of mass commercial emails, is strictly prohibited while using our Course.

27.Data Protection – General Data Protection Regulation 2018 (GDPR)

We place significant importance on ensuring the security of your information. Kindly review our Privacy Policy to gain insights into the measures we take to safeguard your data.

28.Data Protection Declaration

In accordance with the provisions of the General Data Protection Regulations 2018, the personal information you provide will be handled confidentially. However, it may be intentionally utilised for purposes directly associated with the administration of your qualification, registration, and certification, or as necessitated by law, Awarding Organisations, or other regulatory authorities.

29.Intellectual Property

By engaging in the Materials, Course, Website, and any other Services provided by the Course Provider, you acknowledge and agree that these are the exclusive property of the Course Provider. This includes all associated copyrights, trademarks, trade secrets, patents, and other intellectual property, collectively referred to as “Company IP”. You expressly recognize the Company’s ownership of all rights, title, and interest in the Company IP and commit not to utilize it for any illegal or infringing purposes. Any reproduction or distribution of the Company IP, whether electronically or through the registration of new trademarks, trade names, service marks, or Uniform Resource Locators (URLs), is strictly prohibited without the Company’s express written permission.

30.Modification & Variation

We retain the right to modify this Agreement at our discretion and without prior notice. Your acceptance of this Agreement includes an acknowledgment of our authority to modify or revise its contents. All modifications are immediately effective upon posting on the Website and will supersede any prior versions, unless explicitly stated otherwise.

Should any part of this Agreement be deemed ineffective or invalid by a court of law, you agree that the previously effective version of this Agreement will be considered valid and enforceable to the fullest extent permitted by law.

31.Service Interruptions

There may be instances where we need to temporarily interrupt your access to the Course for scheduled or unscheduled maintenance or emergency services. You acknowledge and agree that your access to the Course and/or Website could be impacted by unanticipated or unscheduled downtime for any reason. However, we hold no liability for any damage or loss resulting from such downtime.

32.Term, Termination & Suspension

We reserve the right to terminate this Agreement at our discretion and for any reason, with or without cause. This includes termination if you breach any terms outlined herein, such as violating intellectual property rights, failing to comply with applicable laws, or disseminating illegal material. You, too, have the right to terminate this Agreement at any time by notifying us.

Upon termination, provisions inherently expected to survive termination by their nature will continue in full force. It’s important to note that terminating this Agreement does not entitle you to a refund for any expenditures made with us.
